1. Acceptance of Terms
By accessing or using the familie.care website and services (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform. We may update these Terms at any time. Continued use after changes constitutes acceptance.
2. Description of Service
familie.care is an online directory and marketplace that connects families seeking senior care with independent care providers. familie.care is NOT an employment agency, staffing company, or care provider. We do not employ, recommend, endorse, supervise, or guarantee any provider listed on the Platform. We do not perform background checks or verify the credentials, qualifications, licenses, or insurance of any provider unless explicitly stated.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms. By using the Platform, you represent and warrant that you meet these requirements.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, complete, and current information. We reserve the right to suspend or terminate accounts at our discretion.
5. User Responsibilities and Vetting
Families are solely responsible for vetting, selecting, and evaluating care providers. This includes, but is not limited to, verifying credentials, conducting background checks, checking references, confirming insurance and licensing, and supervising care. familie.care makes no guarantees about the quality, safety, legality, or suitability of any provider, listing, or service offered through the Platform.
6. Provider Listings and Content
Provider listings, descriptions, reviews, and other user-generated content are provided by third parties. familie.care does not verify, endorse, or guarantee the accuracy, completeness, or reliability of any user-generated content. Providers are solely responsible for the accuracy of their listings. Reviews reflect the opinions of individual users and do not represent the views of familie.care.
7. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Post false, misleading, or fraudulent information
- Harass, threaten, or abuse other users
- Scrape, harvest, or collect data from the Platform without written consent
- Impersonate any person or entity
- Interfere with the Platform’s security or functionality
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMILIE.CARE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, ANY INTERACTION WITH A PROVIDER, OR ANY CONTENT ON THE PLATFORM.
OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF TWENTY-FIVE DOLLARS ($25) OR THE AMOUNT YOU PAID TO FAMILIE.CARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless familie.care and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Platform, violation of these Terms, or interaction with any provider or other user.
10. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute arising from these Terms or your use of the Platform shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that you may bring claims in small claims court if eligible.
Class Action Waiver: YOU AND FAMILIE.CARE AGREE THAT EACH PARTY MAY ONLY BRING CLAIMS AGAINST THE OTHER IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
30-Day Opt-Out: You may opt out of arbitration by sending written notice to legal@families.care within 30 days of first accepting these Terms.
11. DMCA and Copyright
If you believe content on the Platform infringes your copyright, please send a DMCA takedown notice to legal@families.care with: (a) identification of the copyrighted work, (b) identification of the infringing material and its location, (c) your contact information, (d) a statement of good-faith belief, (e) a statement under penalty of perjury, and (f) your signature.
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FAMILIE.CARE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause and with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination shall remain in effect.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict-of-law provisions.
